Welcome to userecon LLC, a website where you can advertise your home for sale or rent. This Agreement and userecon.com LLC’s privacy policy governs your use of the userecon.com LLC website, owned and operated by userecon.com LLC, a Tennessee limited liability company. You represent that you are at least 18 years of age and have attained the age of majority in the province, state or country in which you reside, and any information that you submit is accurate.

IMPORTANT: The following terms and conditions apply to all Users of the userecon.com LLC website. Please read this Terms of Use Agreement and Privacy Policy before using this website or submitting personal information that could identify you (including but not limited to name, address, phone number, email address, etc.). BY ACCESSING THIS WEBSITE, THE USER IS MANIFESTING HIS OR HER INTENT TO AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT AND PRIVACY POLICY. "Sellers" refer to users who advertise their properties for sale or rent on the website.

2. MODIFICATIONS TO THE TERMS OF USE AGREEMENT AND SERVICES/LIMITS ON LIABILITY
userecon.com LLC may change the terms of this Agreement and reserves the right to modify or discontinue (temporarily or permanently) the services offered on this website without prior notice to users. Each time you access the website you will be governed by the terms currently in effect. It is the users responsibility to regularly review the terms, conditions and notices. IF YOU OBJECT TO ANY OF THE MODIFICATIONS YOUR SOLE RECOURSE IS TO IMMEDIATELY DISCONTINUE USING THE SERVICES OFFERED BY USERECON.COM LLC. WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY SHOULD WE CHOOSE TO EXERCISE OUR RIGHT TO MODIFY OR DISCONTINUE THE SERVICES. CONTINUED USE OF THE SERVICES FOLLOWING THE EFFECTIVE DATE OF THE MODIFICATIONS SHALL INDICATE YOUR ACKNOWLEDGEMENT OF SUCH CHANGES AND YOUR ACCEPTANCE OF THE SERVICES AS MODIFIED.

userecon.com LLC DOES NOT provide legal advice to Sellers or Buyers of property advertised on the website. userecon.com LLC DOES NOT review contracts entered into by Sellers or Buyers using this website. Legal counsel should be obtained in completing all Real Estate Transactions.

userecon.com LLC DOES NOT accept unsolicited materials or ideas for use or publication on their website. Should you send unsolicited materials or ideas you do so at your own risk. You will not be entitled to any consideration and you are waiving any claims against userecon.com LLC even if the material or idea used on the website is substantially similar to the material or idea you sent.

4. THIRD PARTY AND USER ADVERTISMENT CONTENT AND INDEMNIFICATION
userecon.com LLC is a distributor of content provided by third party advertisers using the website. userecon.com LLC has no editorial control over the content. The information provided by third parties and users of the web site including but not limited to opinions, statements, offers, services, advice, or other information are those of the author of that information and not userecon.com LLC. We do not guarantee or endorse the information, nor are we responsible for the accuracy or reliability of information provided by advertisers or users of the web site. By providing this information to userecon.com LLC, you are granting us a license to use the information any way we deem appropriate. 5. FAIR HOUSING
The Fair Housing Act declares a national policy of fair housing throughout the United States. 6. YOUR PASSWORD AND USER ID – LIMITS ON LIABILITY
When a user sets up an account with userecon.com LLC, the user’s email address will be your User ID. You will also be required to select a password to access your account. You are solely responsible for all acts or omissions that occur under your User ID and password. You agree to notify userecon.com LLC of any unauthorized use of your User ID or password or any other breach of security. If we believe, in our sole discretion, that you have violated this Agreement or acted in a way that violates the letter or the spirit of this Agreement, we may terminate your password, account or access to our services, and remove all posted information, with or without notice to you. YOU AGREE THAT WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO ADEQUATELY SAFEGUARD YOUR PASSWORD AND USER ID OR TO OTHERWISE COMPLY WITH THIS SECTION. WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY SUCH TERMINATION OR REMOVAL.

7. GENERAL USE PROVISIONS
Users may advertise property owned by them on this website as being for sale or for rent. If you post a property listed as an owner, you must have the necessary rights title and interest in the property you list for sale or rent. You may not use a fictitious name to list the property. If you are the owner of property and a licensed Real Estate Agent, you must disclose in the advertisement that you are a licensed real estate agent. All information you provide to us about the property being advertised for sale or rent must be accurate, complete, true, current and not misleading and offered in good faith. You also agree to update that information to keep it accurate, complete, true, current and not misleading and offered in good faith. The photograph submitted to be shown on this website, must be a photograph of the actual property being listed for sale or rent. We will not accept any drawing or other non-photographic representation of the property for the website. We will not accept photographs of similar homes in a users neighborhood. Only photographs of the actual home being advertised for sale or rent. Written descriptions of the property submitted to the website should be accurate with regards to, but not limited to, number of rooms, square footage, acreage, amenities, etc.. You are solely and fully responsible for all of the information you provide to userecon.com LLC. You agree that if all the said information is not accurate, complete, true, current, and not misleading and offered in good faith, we may temporarily or permanently remove your advertisement from the website and temporarily or permanently suspend or terminate any further use by you of the website. We reserve and have the right (but not the obligation) in our sole discretion to refuse or delete any of your information which we reasonably consider to violate this Terms of Use Agreement or to be otherwise illegal. You agree that use of any information obtained through userecon.com LLC or our services is at your own risk.

8. DISCLAIMER OF WARRANTIES
THE PROPERTY ADVERTISING MATERIAL FOUND ON THIS WEB SITE IS PROVIDED BY THIRD PARTIES. YOU AGREE TO USE THIS SERVICE ENTIRELY "AS IS" AT YOUR OWN RISK. RECON LLC ASSUMES NO RESPONSIBILITY, AND MAKES NO WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, AND/OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE WEBSITE WILL FUNCTION ERROR FREE OR UNINTERUPTED OR THAT THIS WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE FOR USE ARE FREE OF VIRUSES OR DEFECTS. 11. CONSEQUENCES OF UNACCEPTABLE USE
We reserve the right to investigate and to involve law enforcement authorities, and to pursue and cooperate with any civil lawsuit or criminal prosecution for any alleged or actual illegal activities involving your use or attempted use of the userecon.com LLC website. We reserve the right to suspend or terminate your use of userecon.com LLC website upon written notice of a violation or attempted violation of the Terms of Use Agreement. Indirect or attempted violations of this Terms of Use Agreement or actual or attempted violations by a third party acting on your behalf, shall be deemed violations by you of the Terms of Use Agreement.

12. LIMITED LICENSE
userecon.com LLC issues to you a limited license to view, copy and download available information on this website provided that: (1) you are a potential buyer, seller of the property or licensed real estate agent representing a buyer, seller, lessee or lessor of the property; (2) the materials are used solely for your noncommercial use; (3) the materials are not modified for distribution; (4) all copyright, trademark, and other proprietary marks are reproduced as they appear on the website and (5) you agree to be bound by this Agreement. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Services provided by userecon.com LLC The Services are provided for personal, noncommercial use only. Licensed real estate agents may reproduce, duplicate or copy the materials for the purposes of showing the property advertised to potential clients.

13. RESOLUTION OF DISPUTES
All disputes over advertising or other services offered by userecon.com LLC, whether it be over the presentation of the advertisement or other issue must be put in writing and sent to userecon.com LLC. Should userecon.com LLC not be able to resolve the dispute and further action is necessary, any and all claims, suits or mediation will be governed by the laws of the State of Tennessee.

14. ANTI –SPAM PROVISIONS AND OTHER UNSOLICITED COMMUNICATION
Userecon.com LLC does not condone or allow spam. You agree not to use the Services offered by userecon.com LLC to transmit, either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail. Users of the system agree not to do the following list of prohibited activities that include but are not limited to:

  1. Violate any local, state, national or international Spam Laws;
  2. Send unsolicited commercial or other emails having large attachments to
    a single recipient; collecting responses from mass unsolicited e-mail messages or generating excessive amounts of Internet traffic using the system or any account;
  3. Relay or transmit multiple electronic email messages or transmit multiple electronic email messages with the intent to deceive or mislead recipients or register for advertising using information that materially falsifies the identity of the actual advertiser;
  4. Harass, stalk, harm another individual using userecon.com LLC’s services, communicate with an individual after being advised to cease communication, make false or unverified complaints against another User;
  5. Collect, harvest or store personal data about other users on the website including but not limited to email addresses, homeowners address, phone numbers or contact sellers for any purpose other than responding to the content posted by such sellers;
  6. You may not misrepresent your affiliation with a person or entity; or impersonate a user of the website.
  7. You may not interfere with or disrupt the services provided by Recon LLC or the servers or network connected to userecon.com LLC or disobey any requirements, procedures, policies or regulation of networks connected to the userecon.com LLC website;
  8. 15. LIMITS ON LIABILITY

Claims for violation of duties or rights under this Agreement will be enforced under the Laws of the State of Tennessee as applied to agreements created, entered into and performed by Tennessee residents, notwithstanding your actual place of residence. All lawsuits arising out of the Terms of Use agreement or your use of the website shall be brought in the state or federal courts having jurisdiction in Montgomery County, Tennessee. You consent, irrevocably, to the exclusive jurisdiction and venue of state and federal courts in Montgomery County, Tennessee in all disputes arising out of or relating to use of the USERECON.COM LLC’s website.

18. MISCELLANEOUS
Userecon.com LLC’s failure to exercise or enforce any right or provision of the Terms of Use agreement does not constitute a waiver of the right or provision. This Terms of Use agreement constitutes the entire and exclusive and final statement of the agreement between you and userecon.com LLC.
